I hereby authorize my child’s participation in St. Francis of Assisi Squire Roses Event in Frisco. I understand all reasonable precautions will be taken to keep my child safe during St Francis activities. I will not hold St. Francis of Assisi Church, the Diocese of Dallas, members of their staff or their volunteers, responsible for accidental harm or injury that may occur during this activity. In case of an emergency during this time, I hereby consent to and authorize the giving of treatment and or medication ordered by a physician or adult for my child’s care. On occasion, video recordings, audio recordings, photographic slides, and photographs are taken of participants of church and diocesan sponsored activities. These are utilized in newsletters, websites, event promotion, and other printed media. I consent to the use of such materials in which my child may appear. I release the staff and volunteers of the above named entities from any liability connected with the use of my picture or audio/video recording as part of any of the above or similar activities..
In consideration for Participant attending the Activities, I, the parent or legal guardian of this Participant, hereby acknowledge and agree to the following pursuant to this Express Waiver of Liability and Agreement (the “Agreement”):
I, the parent or legal guardian of this Participant hereby understand the hazards associated with: (a) Participant participating in the Activities, and (b) the diseases and conditions (“COVID-19”) caused by the novel coronavirus SARS-CoV-2, or any mutations or similar viruses, and am familiar with the Center for Disease Control and Prevention (“CDC”) guidelines regarding COVID-19. I, the parent or legal guardian of this Participant hereby acknowledge and understand that the circumstances regarding COVID-19 are changing from day to day, and that, accordingly, the CDC guidelines are regularly modified and updated. I, the parent or legal guardian of this Participant hereby accept full responsibility for familiarizing myself with the most recent updated guidelines, as well as the most recent guidelines and legal requirements related thereto, and for ensuring that Participant is fully capable of complying with such requirements. Notwithstanding the health risks, which could lead to Participant’s death or serious illness associated with COVID- 19 and with the Activities in general, which I, the parent or legal guardian of this Participant hereby readily assume and acknowledge (for myself and on behalf of Participant), I hereby willingly choose to allow Participant to participate in the Activities and agree to comply with the stated and customary terms and conditions for participation in the Activities, including, without limitation, as regards to protection against infectious disease, including COVID-19 and the requirements for participation in the Activities as set forth by the Church. I, the parent or legal guardian of this Participant hereby understand that my or the Participant’s failure to abide by these requirements will result in Participant being denied entry and participation to the Activities, and if Participant is denied entry or participation, I and Participant will forfeit all registration fees.
I, the parent or legal guardian of this Participant, on behalf of myself and Participant, hereby acknowledge and fully assume the risk of illness or death related to, in connection with or arising out of, the Activities, including with respect to COVID-19, arising from Participant being on the premises and participating in the Activities. Accordingly, I (for myself and on behalf of Participant and all of my and Participant’s respective heirs, successors, assigns, and all of my and Participant’s legal representatives), hereby RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, INDEMNIFY, DEFEND AND COVENANT NOT TO SUE ST. FRANCIS OF ASSISI CATHOLIC PARISH IN FRISCO, TEXAS OR THE CATHOLIC DIOCESE OF DALLAS, its and their respective officers, directors, members, affiliates, sponsors, agents, employees, successors and assigns, and anyone else claiming by, through, or under them (collectively, the “Releasees”) from any and all claims, losses, expenses (including, without limitation, attorneys’ fees, costs and disbursements) damages, sickness, death, bodily injury, or liability related to, in connection with, or arising out of, in any way, directly or indirectly to the Activities and/or COVID-19 which might occur as a result Participant being on premises and/or participating in the Activities, whether or not an action is brought arising from or out of, or relating to, directly or indirectly, the infection of COVID-19 or any other illness or injury which are brought by through or under Participant or me (collectively, “Claims”) EVEN THOUGH SUCH CLAIMS ARE CAUSED BY OR ALLEGED TO BE CAUSED BY THE NEGLIGENT ACTS OR OMISSIONS OF ANY OF THE RELEASEES.
It is my express intent that this Agreement shall bind any assigns and representatives, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, HOLD HARMLESS AND INDEMNITY AGREEMENT AND COVENANT NOT TO SUE the Releasees. This Agreement and the provisions contained herein shall be construed, interpreted and controlled according to the laws of the State of Texas. I, the parent or legal guardian of this Participant HEREBY KNOWINGLY AND VOLUNTARILY WAIVE FOR MYSELF AND ON BEHALF OF PARTICIPANT ANY RIGHT TO A JURY TRIAL OF ANY DISPUTE ARISING IN CONNECTION WITH THIS AGREEMENT. I, the parent or legal guardian of this Participant hereby ACKNOWLEDGE THAT THIS AGREEMENT WAS EXPRESSLY NEGOTIATED AND IS A MATERIAL INDUCEMENT FOR THE PERMISSION GRANTED BY RELEASEES TO BE ON PREMISES AND PARTICIPATE IN THE ACTIVITIES.
IN SIGNING THIS AGREEMENT below, I, the parent or legal guardian of this Participant hereby ACKNOWLEDGE AND REPRESENT THAT I have read the Agreement, understand it and sign it voluntarily as my own free act and deed for myself and on behalf of Participant; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Agreement for full, adequate and complete consideration fully intending for Participant and me to be bound by same.
